Standard Weights and Measures (Second Amendment) Act, 1985

Preamble
Whereas it is desirable to amend the 1968 Standard Weights and Measures Act, now therefore, His Majesty King Birendra Bir Bikram Shah Dev has enacted this law on the advice and with the approval of the National Panchayat.
1. Short Title and Commencement
(1) This law may be called the Standard Weights and Measures (Second Amendment) Act, 1985.
(2) It shall come into force at once.
2. Amendment in Section 2 of the 1968 Standard Weights and Measures Act
Clause (j) of Section 2 of the 1968 Standard Weights and Measures Act (hereinafter called the principal act) has been amended as follows:
(j) Controller means the Director-General of the Department of Weights and Measures.
3. Amendment in Section 4 of the Principal Act
The word and figure "Section 12", occurring in Sub-Section (3) of Section 4 of the principal act, have been changed to "Section 8B".
4. Amendment in Section 16 of the Principal Act
The word and figure "Section 13", occurring in Sub-Section (1) of Section 16 of the principal act, have been amended as "Section 8D".
5. Amendment in Section 25 of the Principal Act
The term "Controller" occurring in Section 25 of the principal act has been replaced by the term "Inspector".
6. Amendment in Section 26 of the Principal Act
The words "His Majesty's Government or the official authorized by it", occurring in Section 26 of the principal act, have been replaced by the term "Inspector".
7. Amendment in Section 30 of the Principal Act
The words "for each offense" have been added after the words "to him by the Inspector", occurring in Sub-Section (1) of Section 30 of the principal act.
8. Addition of Section 30A in the Principal Act
The following Section 30A has been added after Section 30 of the principal act:
30A. Collections to be made as Government Arrears
(1) Fines to be paid in accordance with the decision taken by the Inspector under this act must be paid to the concerned office within a period of 35 days from the date of such decision.
(2) In case the fine is not paid within the time-limit mentioned in Sub-Section (1), the office or officer prescribed by His Majesty's Government shall collect them as arrears due to the government in accordance with current law.
